Re: Receiving Free Games????

I don't think Flight should sweat this too much. If this guy wants to keep sending him games then that's on him. I seriously doubt the cops are gonna show up to his house shaking him down for stolen video games. With that being said though, everything has a price. Don't be surprised if Nasty Nate comes to your house wanting more than your fruit cocktail.

      Re: Receiving Free Games????

      Hi Flight

Let me preface by saying that I have experience in Federal law enforcement and criminal justice.

Now, with that said this contains the attributes of your common internet credit card fraud. Except this is obviously more advanced. Here's how it works.

In it's basic form, someone steals a credit card, makes a purchase online, has it shipped to their neighbors house where they pick up the package before their neighbors get it, and then the police come knocking on your neighbors door once the gig is up while the offender makes away with the merchandise.

In your case, it seems as if the perpetrator has a single or multiple stolen credit cards or more likely hacked pre paid cards. By purchasing items as gifts on Amazon they can do a few things: 1) they don't have to register on the site thus giving away a "paper trail" of activity on a single account 2) they can ship items with various sender and recipient addresses without having to make ghost purchases. Ghost purchases meaning they setup a seller account and multiple buyer accounts to buy their own products.

While you may think you're the only one receiving the gifts, the offender may in fact be sending these gifts to several different people all across the country including the offenders own address (meaning the one they will retrieve their merchandise from). By creating this web of shipments it will make it extremely hard for law enforcement track as it expands several different jurisdictions and could involve dozens if not hundreds of potential offenders. But remember, by the time the offender receives items at the "correct" address they will be gone.

Anyway, with the way Amazon and other online sites work, you can make several hundred dollars worth of purchases and the items will be shipped before a red flag can be raised or the credit account account can be frozen. Once items are shipped they can't be unshipped. The damage has been done.

If it's hacked prepaid cards it's slightly more difficult as the company distributing them would have to identify the security breach which could take months. By then it's really too late and all the shipments would have been made.

So to conclude, yea I believe this is a scam through experience of what I've seen and heard. This is important: While others are correct in saying it's a "gift" and you can't be held liable is just plain wrong. Case law has dictated that this type of defense only applies when you in good faith could have perceived it as nothing but a gift. Which generally means receiving it from friends, family, co workers, etc. Receiving "gifts" from strangers will NOT protect you from a potential claims lawsuit from Amazon for lost merchandise. Obviously, by reading this thread, you can't in good faith believe these gifts were anything but gifts.

What to do: There's really no point in going to the authorities but I would hold onto the merchandise, unopened, and keep a hold of all your contact with the seller and keep urging them to stop. I would also contact Amazon and file a fraud claim just to be sure that they are aware and can verify the legitimacy of the payment being used.

Is it possible that this is legit? Sure. But you don't want to be served papers months or years from now. And yes, with the way the legal system works you could be included in a lawsuit four or five years from now. Just be sure to get all your ducks in a row before you enjoy the gifts.

Yeah good luck with the situation. But I would still put a stop to it. No reason to let some random person in the world send you free things and you have no idea why. Doesn't sound smart to me.

He didn't give me a clear cut answer but assured me that he was "Legit". He then said he went ahead and sent me the games because I inquired about them. STOP!!!!!!!!!!!!! I never asked about Borderlands 2 but I do recall mentioning XCOM so he assumed I wanted it. WTF??? He then said just pay him $60 for the games. To be honest I have no problem shooting him the $60. If this guy has the faith in me to advance me a game which is what he felt he had done in regards to XCOM I don't have a problem paying him in good faith. Hell I think its cool that he did front me the game as he said and then to only ask for $60.

I'm sure some of you will call this a scam but I really don't believe it is. Maybe he just really screwed up which in the back of my mind I still somewhat question what happened but if this guy will send me a game and trust me to pay him whenever? I'm keeping this dude as my "ACE IN THE HOLE"

          Deuces!!!!!

I missed this post. And lol good luck with the scam my man.

                Two possible scenarios...

Sounds and is perfectly legit, don't sweat it and let the games keep on coming.

                or...

Inside of two weeks Flight will be turning tricks or end up dead.

Those are my two, well thought out scenarios.

Interesting and maybe I am missing something, but what does this guy get out of stealing someones credit card and using it to send games to randon people? I guess I am not sure what the scam is on the person receiving a "free" game?

They get a copy of the game/merchandise themselves. They use the gifts to throw off the authorities as to who the real culprit is. I think that's what he's saying, but I could be wrong.

Emailed him yesterday and informed him of what upcoming releases that I want in the future. I did pay him $60 for what he has already sent me so at this point I'm cool with everything. Still can't fully explain it but it is what it is.

Ok...So lets just say Flight "lost" the games? And lets just say yours truly "found" these games.

                                What say ye then?
