Trespass
Officer working as an employee of the business on private property = you can be told to leave the property. If you refuse to leave you are subject to 2nd degree trespass. Officer can arrest for misdemeanors committed in their presence.
Resisting arrest
Subject was clearly resisting arrest from the officer. Failure to comply with verbal commands of the arrest process and not simply letting the officer place the handcuffs on. The officer used reasonable force to take the subject into custody.
Issues I see:
Did officer have visible markings that he was in fact an officer?
Did officer have PC to try and search the aluminum can?
Is this state different with regards to how an officer working off duty at the location can act as an agent of the private property? (NC you can tell them to leave or be arrested)Comment

I'm not saying the cop isn't in the wrong or an idiot. But if he is that "arrest happy", he would be easy to set up (maybe he has a rep in that area....dunno). I just found the beginning of the vid kind of odd and that it didn't pick up from where the situation was getting out of hand, like you might expect. The vid started before the cop walked up. I think there's a little more to this in light of that.
Its been all over the news from what I've seen this far...the guy that was asked to leave the property did leave, and there were no alcohol charges brought up.Comment

The subject just committed a misdemeanor in the presence of the officer.
I listed everything there, both good and bad by both parties. I'm not biased at all, just calling it how I saw it.

Look I have like 5 buddies in my local police force here, it is NOTHING against cops. Yet they will agree also that they can abuse their power. So yea my point is this kind of stuff is getting out of hand. Power can be extended to far and this is becoming more and more the case it seems.
I have no issue with ND, I'm just failing to see the justification is both that does not break a American citizens right to some of these simple freedoms.Comment

This thread is about the original video which I went through and illustrated what my observations were from a professional point of view.

The guy had just got there..said he was waiting on someone whom he thought was right behind him. The guy now has a court case and this cop is probably going to get chewed up by the lawyers

I would also agree that officers abuse their power. It's disgusting and we just had one fired here two days ago for lying on a time sheet to an off duty provider similar to this liquor store in the video.
