I guess my thought is, in addition to locking for the reasons described above, the posters should still get carded... red or yellow, whatever. I think everyone knows the type of threads that have the potential to get ugly and should be working harder to keep it open by staying on topic and within the TOS.
The TOS specifically says not to talk about politics or religion, but there are topics that bleed into the gray. You can start a thread about the oil spill and it's not necessarily political. But, we all know it will turn out that way. A new guy might not understand that about forums, so I'm not sure I would feel comfortable handing out an infraction because they started that thread.
Now, if the person starts an offensive thread with intent to cause an issue, that thread gets closed (deleted if it shouldn't be seen at all) and the individual is carded. I don't really mean starting threads so much as making a post that turns one of those threads into a problem. I'm also not concerned with new people not knowing. I know it's common not to read things like the TOS when registering but that doesn't make it acceptable. I don't think people should get banned, but they should learn that the behavior is unacceptable. Locking threads they didn't create and not punishing them for actually causing the thread to get locked doesn't really teach them not to continue doing it. It just punishes everyone else who has been following the TOS in those threads.Some new guys won't know, however.
