Randomly checked in on the case today, looks like notice went out to the parties that the case will be automatically dismissed due to inactivity in the next 60 days unless any other action is taken.
IMV never responded to the motion to dismiss last September (well before they claim they were scammed themselves), the case has sat static since and used as the occasional scapegoat for a lack of progress.
