For some reason, i have not recieved any notification about an update...is there anyway to know if i have downloaded it?

try to play a game online and just back out. if you can play online you have the patch.

ok, I would try that but I no longer have a gold membership to Xbox Live, but like I said I am usually prompted with an update prompt when updating, this time I got nothing!

Do you have the console set to instant on? (or something like that...) if so, your game might have been update while the console was off (aka sleeping mode).

You need internet connection, but you don't need a gold account if that's what you're asking.
