This has always been so dumb to me because they CAN have the cow, they just cant have the chick fil a sign that it holds. It could hold a sign that said mlb the show and everything would be fine.

      Uh-uh....nope.

With trademarked items.....there is a percentage that it must be different.
That cow would put them WAY into infringement area.

Yeah completely understand the copyright infringement, (although how do they get away with the coke bottle in SF?).

It won't matter in 3 years anyways when they move to the new ballpark, does anyone have any comment regarding the chop audio actually being in?

          Good question....and I don't know...
I just remember when they added the dog......that was the talk at Community Day when asked why no cow.

Please dont try to insult my intelligence with that crap. Look at the fielding gloves, the only thing missing from those is the rawlings brand name, same with the bats. So that percentage of likeness IS way into the "infringement area". Theres no percentage, if you dont use the copyrighted material you can use anything else. The coke bottle at AT&T park is a perfect example. The only difference in the game and real life is the game says "enjoy cola" and the real park says coca-cola. so if thats not in the "infringement area" I dont know what would be. A cow holding an mlb the show sign would be just as "generic" as that bottle at AT&T park in the game.

Lets let the rest of the board decide. If a cow holding a sign that says mlb the show is WAY into this supposed infringement area then how much into the "infringement area" would this be:

This is literally THE bottle from AT&T park with NOTHING but the words changed.

Also I liked how you cut out my example from your quote that proves your "theory" wrong.

                  Okay....

With trademark infringement ....there is a device called "likelihood of confusion"....

Coca-Cola is mainly about their logo....that is their trademark......not the bottle itself...

Now....Chik-fil-A has an ENTIRE section of their website devoted to COWS.

People would see the cow and say....hey ....they got Chik-fil-A as a sponser....that would be infringement. LIKELIHOOD OF CONFUSION.

Coca Cola has copyright on the contoured bottle I believe.

Just to be clear isn't Coca-Cola's saying "Enjoy."? Would that be an infringement?

Classic Coca-Cola bottles have been around seemingly forever. This design patent is for the well-known bottle that holds the sweet soda.

Even your link contradicts what you said.

"Under some circumstances, trademark protection can extend beyond words, symbols, and phrases to include other aspects of a product, such as its color or its packaging. For example, the pink color of Owens-Corning fiberglass insulation or the unique shape of a Coca-Cola bottle might serve as identifying features.

doesnt sound like "just the logo" to me. Im pretty dang sure that VERY recognizable bottle would be "likelihood of confusion" as well.

They likely have.....that's why I said a percentage of change is acceptable.
The legal department at Sony must approve all of the in-game signage and symbols.

                              The cow did not fly.

Does anyone really think that they could have added the cow and instead went with a dalmatian?...for ****s and giggles?
