He could easily be arrested for what he did. If the ump wanted to press charges it would be a slam dunk case. Then it's up to the judge...

It's not out of the question. That's friggen assault any way you look at it.

If that ever happened off the field it'd be a no brainer.

So then, do you think he SHOULD go to prison? BTW, isnt the legal definition of assault hinge on whether there was a perceived threat by the assaulted party and that the assaulter had the capacity to follow through on the perceived threat? Here, there really didnt seem to be a perceived threat. It looked like it was a complete surprise as if at no point did the umpire consider that Young would hit him with a bat.

Being that I'm not a judge in that state I have no idea what the penalties are for battery with a baseball bat. If the penalty is prison, then yes I think he SHOULD go to prison.

Thats good to hear. Its nice to see someone who makes reference to criminal dimensions of what occurs on the field is willing to make offenders FULLY accountable. A lot of people clamor that he needs to be taught a lesson like there can be no gray area, etc but they fall short in making him fully accountable which makes little sense.

I don't understand how this thread has over 60 replies.

He threw a bat at an umpire. I would have thought the sanctimonious holier than thou posts would have been flushed out a day after this happened.

I watched the video of this toss, and I found it to be pretty hilarious to be honest. High comedy. He gets called for strike three (on a pitch that is not a strike FWIW), and just stands in the box while the next batter walks up. He probably talks some $hit to the ump, then proceeds to move off camera to the left. Suddenly, you see a bat flying in a left-to-right direction and drilling the bozo ump in his chest.

                Pretty good stuff.

Merely semantics. You are correct about the legal definition of assault, however, Delmon's actions certainly constitute the requirements for a charge of battery.

and yes in a way it definatley isyour exactley right about them wanting to hold off on calling him up but the fact was he wasnt going to be called up anytime soon anyways

The only reason I did that was because of this quote:

I think you suspend him for the season and make him go through anger management training before allowing him back into baseball next year.

There is simply no excuse, and I can careless that he apologized because he has to. I am glad the umpire is ok.
