If you guys think that's bad my sisters ex-boyfriend has 6 DUI's and he's not in jail. He's served about 2 years of prison time from all of them but he's out and driving around (illegally as he has no license) as we speak. And yes he still enjoys his booze. It's just a matter of time before he kills himself or others or both.

Our justice system is ridiculous and I absolutely hate it. I have a friend who was killed in 06 by a drunk driver while evading police. What did he get? He got 8 years in prison. We were all beyond belief pissed off and will never ever understand why (the guy was pretty well off financially). Although he didn't have 6 DUI's, this would have been his second. Disgusting to say the least. I am glad this creep will most likely spend the rest of his life behind bars. RIP Adenhart.

hitstreak, you got that right, I really can't understand how someone who has 6 DUI's is still driving around. Like I said he's driving illegally but the point is he's still driving at all. Or that he's still free at all! Why hasn't he gotten like an 8 year sentence? As for your friend, that 8 year sentence is outrageous. He must have caught a break due to a prosecutor who needed a sure-conviction or something to get that. He should have gotten at minimum 20 years in my opinion. That's outrageous I agree.

Re: Nick Adenhart Killed In Car Accident

You know, anybody can have a few beers too many at the Christmas Party, and get into some hot water with the law, but hopefully that instance is an isolated one, and the guilty party realizes the mistake that is made, and rectifies the situation down the road.

          First Strike.

The guy that habitually gets into his car and drives drunk needs to face a penalty of a more severe nature. The trouble is the law has a hard time ever being right. They say hindsight is 20/20 so realizing that you should have put a guy away after the very first conviction is easy to do from the Monday morning quarterback chair.

Living with yourself after you gave a guy a break-and then get rewarded by your leniency with a heart-wrenching case involving the same defendant years down the road...

No one wants to have to live with that.

But, when you are on the bench, and you see a rap sheet a mile long for the same thing over and over and over again, you have to at some point realize that for the safety of others, and those around this menace, the time for lenience and kindness have run their course.

First Strike DWI= License suspended for a year
*Second Strike Conviction= One year in jail.

*If the second strike occured within the time frame of the first year whilst the license was suspended, mandatory 5 year sentence with lifetime revocation of driver's license.

The trouble is if the drunks only ran into trees and killed themselves, the system would police itself.

Unfortunately, this is not the way it typically goes down.

I agree, 1st strike = license gone for a year, 2nd strike = one year in PRISON (not jail), 3rd strike = 5 years in PRISON with 5 years probation, 4th strike = LIFE.

I know that some folks will say that the prisons are too crowded so maybe there would be some other way, such as alcohol testing or something. I don't know, all I know is the system as it is now isn't working when someone can be driving around just willy nilly after 6 DUI's!!!

Re: Nick Adenhart Killed In Car Accident

By the way, I love my booze as much as anyone but guess what, I take a CAB or have a friend drive me. And guys believe it or not I get teased and berated from my friends for doing so. Yes we meet up for OSU games or whatever and I catch hell for my cab rides. They call me a big wussy who "can't hold my liquor". Women seem to think what I do is very commendable though, I hear a lot of things from women saying how responsible what I do is. I just smile and tell them I'll wave from my cab when I see them handcuffed in a squad car on the side of the road someday.

I think it's that BS macho mindset that causes a lot of guys to not take cabs honestly. I don't like being teased about it but it's not going to change me into drunk driving either. However I know a lot of guys may get some ribbin' about it and then not want to take a cab. So do us all a favor, if you guys know of someone who is taking a cab from a bar, don't grief them over it, instead buy them a drink for being responsible. We'd have a lot less deaths and maimings on our hands if not for this type of nonsense.

That’s messed up. I’ve never had anyone make fun of me for being responsible. Usually taking a cab is encouraged but Im also in the military so our job is at stake too.

As for DUI's I think the first one is "okay" as in you shouldn’t serve jail time. Everyone is allowed 1 mistake but for the 2nd one I think you should go straight to jail for a while. If we made the laws tougher I think we would have fewer accidents.

There was a news article about Anchorage around Thanksgiving that said there were so many DUI's this year that 1% of the city has been arrested for DUI’s.

I mean Anchorage is so bad that this guy was arrested for his 10th DUI!!!

I'm sorry, how is a DUI a mistake? I just don't believe in that kind of thing. It's not a mistake, you're warned your entire life. It is an idiotic, illegal act that deserves punishment. If they weren't pulled over for serve offense for that DUI, they could have done exactly what happened here and we never would have known what could have been prevented otherwise.

He didn't say one dui shouldn't have any punishment, just that it shouldn't equal jail time.

It's not realistic to lock up every person with one dui.

I'm not saying 51 to life, but yes it should be criminal punishment.

But this is just one man trying to avoid a "mistake" like this happening again. A first or tenth time doesn't matter, you're still potentially putting yourself in the same situation.

You are lucky he even got 8 years, seriously.

I'm a cop and I can't tell you how much the system is set up for people to get off. It is very, very, very difficult to get a conviction. And when you do...they give them a slap on the wrist.

In all honesty I haven't seen background really matter either. I mean the scum of scum (10+ arrests) get off the hook routinely.
