What you arent seeing (and MS is risking) is that this will potentially lead to a lawsuit. This is a violation of the first sale doctrine in copyright. It also is the only item I can think of (that isnt consumable) that you can purchase but are restricted when it comes to reselling or giving.
All types of items from cars, homes, clothes, media etc. can all be resold to whomever the owner of the item wants. Also when those items are sold, the manufacturer doesnt get a cut from the sale or charge the new owner a fee to use the item. Its like me buying a Benz from a friend and having to pay MB $5,000 to get a key to start the car.
I own both systems now but I dont think I'm buying an XB1 if these restrictions stay and if the PS4 doesnt have these restrictions. We will see tomorrow what Sony does but I dont know how anyone could be happy with these restrictions.
