Duke Nukem Forever Lawsuits Settled
3D Realms/Apogee Ltd. and Take-Two have settled their differences and filed to dismiss their litigation over Duke Nukem Forever.
"The above action, including any and all claims that were or could have been asserted by the parties, is dismissed with prejudice in accordance with the terms of the Settlement Agreement executed by the parties on May 14, 2010," reads the filing made May 28.
With the legal drama out of the way, the road to the long-awaited release of Duke Nukem Forever is apparently clear of legal hurdles--the game just needs to be finished.
Take-Two, the publisher of the notoriously long-in-development shooter, initially sued 3D Realms/Apogee Ltd. after the studio let its development staff go, which Take-Two took to indicate the cancellation of Duke Nukem Forever. 3D Realms fired back with a counter-suit of its own, revealing that the game was still in development.
"Dismissed with prejudice" means that neither can file another suit on the same claim. Details on the "Settlement Agreement" were not available, though the U.S. Trademark Office indicates that 3D Realms/Apogee Ltd. still owns the Duke Nukem property.Go Noles!!! >>----->Comment

Rumor: Borderlands Studio Reviving Duke Nukem Forever
There may be hope yet for the ludicrously long-in-the-making Duke Nukem Forever. Sources claiming to have knowledge of the situation tell Kotaku that Duke Nukem Forever development continues at a new home, Borderlands developer Gearbox Software.
The studio responsible for Brothers In Arms, Borderlands and Aliens: Colonial Marines is said to have picked up Duke Nukem Forever development where former studio 3D Realms left off, perhaps Duke's best bet for eventual completion.
Duke Nukem Forever, according to sources who wished to remain anonymous, is now in the hands of Gearbox and is planned to be released under the studio's name. Gearbox was outed as the developer of the apparently scrapped Duke Nukem spin-off Duke Begins earlier this year.
Take-Two Interactive still maintains publishing rights to the title, which the company confirmed to Kotaku tonight. (A company spokesperson declined to comment about the status of the Duke Nukem Forever project and whether it is in the works at Gearbox.)

Funny that they mention that Gearbox is a developer of Aliens: Colonial Marines, which has been delayed since 2008.
I'm not optimistic, but "Chinese Democracy" did eventually get released after 15 years of recording, so maybe Duke Nukem will too.Comment

this would actually make sense. I remember hearing this rumor floating about earlier in the year on the Gearbox message boards, but nobody could find any kind of proof so it was dismissed as a joke. After Gearbox finished the third Borderlands DLC, The Secret Armory of General Knoxx, they claimed they were hard at work on Aliens: Colonial Marines. That would be fine except no new media or news has emerged about ACM, and, as stated above, it has been delayed several times.
I just hope that if this is true that it doesn't mess with Gearbox producing a Borderlands sequel.Lux y VeritasComment

DNF was supposedly like 90% done anyways, so Gearbox should be able to just polish some stuff up and get it out quickly. No need to do massive reworking anymore at this point, as it'll interfere with more relevant projects, and I'm sure Take 2 just wants it on shelves.Comment

more evidence? apparently six former 3DR employees went to Gearbox after losing their jobs at 3DR. In 2007 Gearbox was said to be working on a game titled "Duke Nukem Begins" but nothing about the game really surfaced. Gearbox has three big titles in the works. One is Aliens: Colonial Marines, the next would most likely be Borderlands 2/Borderworlds, but what could the third possibly be? No way it's a new IP. Also, when asked about possibly working on DNF, Gearbox president Randy Pitchford didn't deny it, and said he was hoping to clarify things at the Penny Arcade Expo (which is in September).
To me, it seems pretty clear Gearbox is working on a Duke Nukem game. But what game is it? Is it DNF, Duke Nukem Begins, the canceled-PS2 game Duke Nukem D-Day?Lux y VeritasComment
