If my relative was in MA or CT, I'd tell them to wait a few months and let me get my bar license. The statute of limitations won't run in that short time, and I'd handle it at next to no charge. However my relative is in a state I have no intention of taking the bar exam in, so that isn't an option.
I also don't want to be in a position where I could even be accused of the unauthorized practice of law, which this is very borderline on. I also don't know how to properly value the case, I checked jury verdicts in the state and nothing is close to the facts, so there is no basis. I know a semi-similar case settled for $25,000, but the differences in this case are enough to really make me question if that is too much or maybe not enough.
I also don't want to reveal too many facts, but let me say if this went to a jury the reasonable person would be shocked. The similar case didn't have that going for it. However the similar case had a permanent injury, my relatives does not.I also wouldn't want to say ask for $25k when they could get up to six digits because I can't value a case in that jurisdiction. I really think this could have 6 digit value in the right circumstances, but I am just not sure and I don't want to hose a relative.
