Baggy pants ban "unconstitutional," rules US judge

MIAMI (AFP) - A Florida judge has deemed unconstitutional a law banning baggy pants that show off the wearer's underwear, local media reported Tuesday.
    <SCRIPT language=javascript>if(window.yzq_d==null)window.y zq_d=new Object();window.yzq_d['MannF0wNBkg-']='&U=13f180hmk%2fN%3dMannF0wNBkg-%2fC%3d674272.12804985.13083877.1442997%2fD%3dLREC %2fB%3d5406809%2fV%3d1';</SCRIPT>
A 17-year-old spent a night in jail last week after police arrested him for wearing low pants in Riviera Beach, southeast Florida.
The law banning so-called "saggy pants" was approved by city voters in March after supporters of the bill collected nearly 5,000 signatures to put the measure on the ballot.
The teen would have received a 150 dollars fine or community service, but he spent the night in jail due to a history of marijuana use, the Palm Beach Post newspaper said.
"Somebody help me," said Palm Beach Circuit Judge Paul Moyle, before giving his decision.
"We're not talking about exposure of buttocks. No! We're talking about someone who has on pants whose underwear are apparently visible to a police officer who then makes an arrest and the basis is he's then held overnight, no bond."
"Your honor, we now have the fashion police," added public defender Carol Bickerstaff, who asked the law be declared "unconstitutional."
The judge agreed with Bickerstaff immediately, reported the Post.
Laws that ban low-slung pants are on the books in several US cities, including Delcambre, Louisiana, where offenders can be fined up to 500 dollars or jailed for up to six months.
Dallas, Texas and Atlanta, Georgia are among the larger US cities considering similar measures

damn 500 dollar fine.....better get some suspenders fellows

Baggy pants are still in style?

I agree with the C though, very stupid idea in the first place.

I don't recall reading anything about pants one way or the other in the Constitution.

Regardless, there are bigger problems facing our nation and its states than baggy pants.

I don't see how this is unconstitutional.

This is to get the type of people who are wearing baggy pants to leave the areas that they are hanging out if they don't want to pull up their pants. These people though not all of them, are committing crimes. If you make it a problem for them to gather and hang out, they will leave and most of the crime will leave with it. Basically it is another way to keep young people from gathering in large numbers in one area.

wait...are you serious? A law that stereotypes like that would never hold up in court.

The baggy pants make them easier to catch so let them wear them. Several people here in ATL have been caught by the police because their pants tripped them up.

I despise saggy pants, but it is ludicrous to ban them. Let people wear them how they want!

This has to be one of the dumbest things I've ever heard in my life. Keep young people from gathering in large numbers. This isn't what this is about. And way to stereotype, they're committing crimes. That's just an ignorant statement.

I don't care if someone wears baggy pants. Sagging is another story. I just don't want to see any man's underware.

The fact of the matter is,who cares whether you want to see it or not. If they want to wear them that way,it's their business. If you're gonna start laying down fines, then you have to go all the way with it. You can't ban some and then let other stuff that's just as obscene slide.

1st Amendment would be my guess to say this is "unconstitutional", I suppose there would also be an 8th Amendment claim as well given the fairly excessive fine for wearing them.
