    Ohio Judge Orders Athlete Cannot Participate in Team Sports

    HAMILTON, Ohio -- A standout Ohio athlete has been ordered to stay on the sidelines after pleading guilty to felonious assault.
    Dwayne "Deejay" Hunter, 19, was sentenced Thursday to 180 days in jail, 500 hours of community service and five years of probation. Among terms of his probation, Hunter cannot play organized sports -- not even intramurals.
    "We're going to see who Dwayne Hunter the person is, not who Dwayne Hunter the star athlete is," Butler County Common Pleas Judge Andrew Nastoff said, according to the Cincinnati Enquirer. "You're 19 years old. And you are standing right here, six inches away from a prison number and the potential to go away to prison for eight years -- that's two presidential terms."
    With credit for time served, Hunter will be released from jail just before Thanksgiving. He will not serve additional jail time unless he violates any aspect of the conditions of his probation, Nastoff said.
    The former Middletown High School football and track star pleaded guilty in July to felonious assault for shooting a 15-year-old boy twice in the face with a BB gun. Hunter fired the gun from a vehicle, with one projectile striking the victim's eyelid, according to the Enquirer.
    "You were probably an inch away from blinding someone," Nastoff told Hunter, according to the newspaper.
    Nastoff told Hunter he must get either a full-time job or enroll in full-time schooling within 30 days upon his release from jail.
    Hunter had been recruited by the University of Tennessee and Big Ten and Big East schools, but they backed away after Hunter's legal problems surfaced, according to The Associated Press.
    "Virtually every Division I school was interested in him," Hunter's attorney, Frank Schiavone, told the Enquirer.

    Wrong. I think we need more tough judges like this. If he ruins his life because he can't play athletics, might say that is a pretty pathetic life. Athletics aren't everything, only a small percentage get to go play on Sundays. How do we know this kid could have made it to the NFL? If he is doing dumb stuff like this in high school, who knows what he would do in college.

      I don't know the whole story (if he has an extensive background, etc), but I will say that this is what you get when you do things that get you put in front of a judge. I don't feel bad for a kid doing drive-bys with a bb gun. It does seem a bit harsh though...

        Playing football in college isn't solely about going to the NFL. This judge basically took away his opportunity to go to college where he could have improved his station in life. He made a stupid decision yes, but when one of the goals of prison is rehabilitation a decision like this kills any chance that could have happened for this individual.

          i applaud this judge...

          athletes are told they are special...most have this "entitlement complex" in which they think the world will bow down to them because they can throw a ball well, run fast, or jump high.

          true "punishment" isn't slapping a kid on the wrist and handing him probation... Punishment should hurt a bit. This judge is more concerned about this kids' life and character - kudos for sending a message!

            I can't form an opinion without having a basis for comparison. What would a normal kid have received? If the jail time, community service, and probation are standard, and the sports ban is extra punishment on top of that, it's not fair. But if the sports ban is keeping him out of an extended jail sentence, I don't see the problem.

              good for the judge...kid will be out n 180 days hopefully he learned from his mistake,yea it sucks taking his sports away,but damn he is 19 still in high school..what was he on the 5 year plan? lucky he didnot shoot the kids eye out with the bb gun,and get more than what he got....just my 2 cents!!!!

                  seems kind of like a silly sentence to me that he can't participate in team sports. It's like the judge is insinuating that team sports are the reason why this kid commits crimes. I can see jail time, service hours and probation but to take away one avenue where the kid could really apply himself, and one of the only things he's apparently been good at, doesn't sound like it will help at all.

                            Exactly and what would it hurt if this kid had to work himself through college instead of getting it all paid for to throw a ball or run?

                            I think it would be better for the kid to go to college and have to pay for it and have him respect it, instead of getting a free ride and likely wasting that money.

                              stupid decisions and shooting a 15-year old twice in the face with a BB Gun are two different things meng. I don't know about you, but this kid sucks and deserves everything he's getting.
