I think we'd all have to see what went down to draw a conclusion. If the toy poodle was trying to attack the guy and he hit it...I don't agree with him but he could articulate his actions.

I guess I'm seeing this as a dog running up to him barking and he takes a big swing at the dog to shut it up and accidentally kills it then says "I think something is wrong with your dog".

I agree...if it's a "get the hell away from me and don't bite me" swipe it's one thing, but if he took a huge death blow it's way different.
