    Child Protective Services

    As some may know, I had a son in April. Well on Monday my wife noticed some bruises on him. She thought that maybe I was tickling him yo hard. In my opinion I don't think I was. I tickled him before and left no marks.

    On Tuesday, I get a message from my wife saying CPS has been called and they're taking my son and my wife away and I would not be allowed to contact them whatsoever.

    So I immediately left work and went home to see what exactly was going on. I get Home and my door is open and my ps3 is missing and all my games. I call the cops and explain that I came home to find my wife, child, ps3, and games all missing. The cops says they have no record of anybody coming out there and basically says that since my wife is gone and "could" have taken my ps3 theres nothing they could do.

    A few weeks ago I was robbed and I think who know who did it but there is no name on the police report or at Bookmans. I'm pretty sure she is the one to call CPS and was the only one to know that my wife left the apt.

    Today they called me in for questioning. I told them my side of the story. ABout the robbery and neighbor. And also file a police report for last nights theft. I also found out today that the neighbor had her son taken away fro something a,lot worse than she told us which was drugs. The cops have been trying to get in touch with her. She also has a warrant for her arrest.

    Now I'm stuck here with an order to stay away and notr to communicate with my wife for the next few days. My wife said that the CPS workers were very rude telling her that if we can't take care of the baby they'll find someone else who will.

    Again I'm pretty sure I know that she called them and I wouldn't put it past her to harm my child.

    Anybody have any thoughts or suggestions?

    It's all very frustrating. I've been robbed. KIcked outta my own house and, been excommunicated from my wife and son.

    As an Police Officer we see this all the time. My suggestion is to go ahead and get with an attorney and make sure that everything and I mean everything is document.

    Get a little note pad and document every. As Police all we do is enforce the law that has been given to us to enforce. The judge will be the detaining factor but make sure you document everything and communicate fully with your attorney.

      I just feel like they don't have the authority to detain my wife and child without letting me know and keeping them from contacting me. Also will there be a trial or anything?

        Any CPS hearing or stay away order in Maryland yes there is a time you will go before a judge.

        In Maryland there are temporary orders which then require a court hearing to extend to a permanent order. You may want to check with your local court system on this an see how they do it because it maybe different then Maryland.

          They do...but it's a temporary order until there is some sort of hearing.
          Comply with the orders...get a lawyer and have any contact in regards to this situation done through the lawyer.
          It may make a difference at the hearing.
          Any sort of "erratic"(which is crazy because I know...you only want to talk to your son) behavior will be marked against you. Take great care not to make any threats against your wife or any family members as they may be provoking you in order to get it on tape or just to report it.

            Couldn't follow it all. Is it your wife who called CPS or your neighbor?

            If it was your neighbor, it shouldn't be to hard to get the problem taken care of, but you will have to follow the process. They are there to protect the kids, so even with a false claim like this, they have to follow through and treat it like you are doing something wrong. I would write everything that has happened down and talk to a lawyer. Then also write down everything else that happens now.

            Hopefully this gets taken care of soon without you having to pay much money.

              I'm confused on what is going on too. From what you said you make it sound like your wife called CPS, took your stuff and left. Then a neighbor who is on drugs comes into play.

              Best thing to do is hire an attorney like everyone else has said.

                Hire an attorney, do everything the attorney (and CPS) recommends. Prove you're a good dad without drug, violence, etc problems and things should be fine. That's all you can do.

                  First thing like everyone here has stated his hire a lawyer. Document everything you can possibly document. Also I'd recommend not trying to contact your wife in anyway , shape , or form.

                    Take this advise as I would suggest the same as this is also coming from another Police Officer here in Maryland.

                        The neighbor called cps. She is also the reason for the 11 bruises. That's a felony. The cops have also determined that it was she who robbed me. Keep in mind we were helping her financially by giving her money and food. She's now 8 months prego. She's avoiding the law cause she has a previous warrant and now she will have a.nother one. The child abuse which is a felony. I'm back with my family now. I just hope I can get some kind of restitution for all my losses. Ps3. About 20 games. 11 bruises on my son. I would also like to call for defamation of character and also mental stress to me my wife and the baby. Also she stole my debit card and withdrew 160.

                          Wow man thats crazy, I would absolutely push for every possible charge you could against her, harming your child alone is just plain nuts, not to mention the other things she did when you and your family were trying to help her out.

                          I can't even imagine what you would have been going through in that time having to be away from your family like that.

                          Glad everything seems to be working out for you though and that they know she was behind everything.

                            It just goes to show if you help some people they will try to take everything, and I mean everything, from you.

                              Let authorities handle it from here you and you family have had enough stress. You may have to civilly go after her for restitution if the judge doesn't make her pay restitution. And if you want to pursue the defamation of character and mental stress you may have a case for mental stress but where defamation of character come in. Just asking we do not deal with civil aspects so I am just curious.
