    So a dog came into MY yard, and my dogs went at it...

    My wife and I were walking our dogs around our back yard each of us had a dog (each are about 50 lb lab mixes). The neighbor dog (very small some sort of doodle, I think) came charging at them and my dogs went at it. The dog my wife had ripped the leash from her hand as my wife hit the ground, I (with the other dog on leash) went to grab the other dogs leash when the small dog came charging towards us. As I grab the leash of the other do, my dog got the small dog in her mouth. I had to grab the mouth of my dog to get it free then the other dog grabbed it for a moment.

    The dog survived, seemed to be fine just shook up. The owners of the dog were outside and saw it come to us but didn't do anything til I had both of my dogs and yelled "COME GET YOUR DOG!" I then took mine inside while my wife held theirs and talked with them.

    My question is, could we face any legal trouble if their dog is injured when it came into our yard?

    I'm pretty aggravated with the whole thing, mainly the fact that none of them came for their dog until the incident was done. I couldn't even stand out there to talk because I had nothing nice at all to say.

    Well, if they did anything, they would say your dogs attacked their dog, and you are saying the exact opposite. It would be a case he said/she said on what actually happened.

    I've had a similar thing happen one time while I was coming back home. These people let their dogs run at my truck and didn't try at all to get them and they were barking and running in front of my truck, so I was forced to stop and go about seven times and I was getting really pissed because I didn't want to hit the dogs. I got lucky that the dogs chased some other car and I was able to gun it out of there.

    People who don't care when their pets run off me off, because it's their laziness that caused the problem.

      In a perfect world, nothing would happen. Unfortunately, the dogs are probably going to get taken until the investigation is over, at least that's what I've seen happen in these cases.

        I looked into local laws, since their dog had no sort of restraint (leash, fence, etc) and it came onto OUR property, we are in the clear...at least that is what I got out of it. My wife picked up their dog to help protect it and it bit her thumb which wont stop bleeding, I think we are even.

          What investigation? Dog trespassed onto his property, the people can try to start something but won't get very far. His dogs were leashed, the neighbors was not.

          I would not worry.

            Because whenever there's any type of attack like that, even though they were defending their home, there's usually some type of investigation. That would be like saying "What investigation?" if someone broke into a house and the home owner blew them away. There's going to be an investigation.

              IF they decide to try charges...which I have no idea if they will, we just moved in a little over 2 weeks ago and haven't really interacted with them. Not exactly how I wanted to "get to know" our neighbors.

                    Not every house has one. We just built and moved in, we have plans for a fence but have other items to tackle first.

                      You can't just do "any" fence here, has to be a nice one. I'm not certain but I think the neighbors dog is small enough to fit through the style of fences here anyway.

                        Makes sense just wondered....they shouldn't have their dogs off leash without a fenced in yard IMO

                          Basically anything that happens on your property could be your responsibility. They would have to sue you and your home owners insurance will then fight it for you.

                          Stupid things like someone robbing you and getting hurt on your property, they can sue you. I had some kids in my neighborhood that kept using my basketball hoop and I had to make them stop for that reason. Didn't want one of them getting hurt and then the parents sue me.

                              What changed? Just a few weeks ago you were talking about the kid in the Alabama stuff outside playing basketball on your hoop.
