I dont believe there is a deadline because if I recall correctly McKinney took his hold out well into the regular season when he came out of Miami.

The 49ers will hold his rights up until next year's draft, so there's no immediate worry of him being taken out of the game.

This is true, but since he's not signed he won't be on the team. That means he could be taken out of the game. The 49ers have the rights to him, but he doesn't play for them yet.

I'm sketchy on the exact rule but I remember Bryant McKinnie held out on the Vikings until almost week 8 of the NFL season. From what I remember had a deal not been reached soon after, he could've sat out the rest of the season and reentered the draft next year.

There is no deadline. The 49ers retain his rights until draft day 2010. Meaning if he were to holdout the entire regular season and decide to re-enter the draft, he could not hold private workouts for other teams unless the 49ers gave him permission to do so.
