    I have as much disdain for the Patriots as almost anybody but this is such a shame.I'm not really sure how the few people here that seem so confident that he didn't do it can think that way.At the same time we have to let this play out but I would certainly say it doesn't look good.

      It's truly the mark of a low person to use the murder of a human being as a slight against a sports organization. I suggest less time on the internet, and more time soul-searching to find a shred of humanity and common decency.

      But I digress.

      This whole thing is a mess. They must really have a strong case against him to go straight-up homicide charges.

      As much as this is about football -- star player on a perennial powerhouse team -- we cannot let ourselves forget that a young man was taken way too early in life. At this point, as a citizen and a person with a career in the legal field, I can only watch and hope that a fair trial weighs the case at hand and determines whether or not Aaron Hernandez is guilty of murder.

              Typically Murder 1 must show pre meditation. So I am sure they have some kind of evidence that prove this was pre meditated.

              And in a lot of jurisdictions Murder 2 is an underlying charge in Murder 1. So they can work a plea deal for Murder 2.

                    Correct. Massachusetts declared the death penalty as unconstitutional in 1982. They rarely issued it before that, though, as the last state ordered execution in Massachusetts was all the way back in 1947. A first degree murder conviction there is generally a life sentence with the first eligibility of parole not being until after 25 years and one day of the sentence have been served.

                      I knew 1 was premeditation. I see your point on the second part. See that on Law & Order all the time. lol

                      It just seems like I see more murder 2 charges than 1 since premeditation is so hard to prove.

                        My guess is they think they have some type of layup on the texts telling his boys from CT to come up and telling them to hurry up.

                          Even the things he did to try to cover it up were dumb. I mean really? You're going to throw away everything you have because you didn't like what a guy was saying?
