"The copyright infringement comitted when downloading a movie or mp3 is nothing more than a civil offense. No one is being deprived of phsycal property. At best, you could argue that a company is being deprived of profits because the infringer will not buy the song or movie that they downloaded. However, none of that is relevant when dealing with a TV show that was broadcast recently and is not being offered for sale by the copyright-holder in any market.

The Supreme Court has long held that it is "fair use" to record programs off TV in order for people to "time shift" when they watch their episodes. If not, VCRs, Tivos, DVRs and DVDRs would all be illegal. Clearly, they are not. When the program in question was being broadcast on a FREE network such as Fox, there is absolutely nothing wrong with downloading it off the internet. It's no different than recording it yourself. Anyone who thinks otherwise is full of it."
