    Parapelegic rams cops and tosses urine from catheter bag




    CINCINNATI — A 45-year-old paraplegic rammed his wheelchair into an officer, threw urine from his catheter bag at a patrol car and spat at the officer, police said Sunday. Ralph Evegan was arrested on charges of assaulting a police officer, obstructing official business, resisting arrest and disorderly conduct.

    Evegan's lawyer said the case is a misunderstanding, and that his client was just trying to break his fall after the officer threw him to the ground. Police said they originally had gone to Evegan's apartment to arrest him on an old disorderly conduct charge.
    Hamilton County Municipal Judge Ted Berry ordered Evegan tested for diseases that can be transmitted by bodily fluid.

          Based on what this guys LAWYER said? It was just a misunderstanding? I think he would have said something a little more forceful/clearer than "misunderstanding" if this guy didn't do anything wrong. People in wheelchairs can assault police officers too.

              And police officers can use excessive force (and isn't like the Cincy PD has never been accused of this), which is what I would call slamming a paraplegic to the ground.

                  How so?

                  It says right there that the officers were only there in the first place because he was being disorderly.

                  Obviously he had done something to someone to trigger the police arriving, so he already has proven to be some sort of a menace.

                      This is based on what his lawyer said. Obviously, like one poster said, they went to his house with either a warrant/probable cause to arrest, and did the man throw the catheter content first? Who knows, but to base any suggestions, one way or the other, on this flimsy report based on the words of the criminals behavior as stated by his lawyer is a little premature.

                      Of course lawyers are to be held in higher esteem than most cops. They can always be trusted to give an unbiased opinion and nothing but the facts.

                        I don't know why you changed your earlier post. You had it dead on. If there was excessive force, especially used against a disabled man, don't you think that the attorney and ACLU would be all over this?

                        No one knows but the people who were present when this all went down. I would definitely take a man down who assaulted me with bodily fluids. That is a C felony and if the fluids were contaminated with some type of disease possibly worse. The man obviously has health issues so I don't see why him throwing potentially deadly fluids at officers falls any short of assault with a deadly weapon.

                        It's always easy to sit back and take months to critique a decision someone had to make in 1 second or less.

                          I changed it because I the first time I didn't read that the lawyer said that excessive force was used. Throwing a parapelegic to the ground is excessive force. I'd really chalk this one up to the guy just having a crappy lawyer. And I don't think you'd die from having someone's urine on you. You could just wash it off. Not to say that I wouldn't walk around and have people urinating on me but it's not that terrible.
