Bingo. That is why it's considered assault when you hit a police office with bodily fluid. Not to mention that urine can transmit MRSA which I believe stays in your system forever.

It's not a felony because it's gross, but rather because the right person can use it as a deadly weapon. I also think it gets bumped up regarding the persons intent and whether they know if they have a disease or not.

I agree with the cops. Slam him down, if not, you're involved in a high speed chase in which the parapelegic, the cops, and pedestrians are all at risk.

If you want to put cops in the same category, I guess so. I was a city cop. This lawyer says it was a "misunderstanding"????? What? You'd think he'd be coming out with something a little stronger than that.

My point is that this article sure lacks any substance to say the cop deserves it.

Re: Parapelegic rams cops and tosses urine from catheter bag

I've seen cops have to deal with 2 mentally handicapped people, one who was in the wheelchair and also was physically handicapped. The one in the wheelchair, they had to try to get him restrained in the chair, but they couldn't. They had to get 5+ cops and then 4 paramedics to get him out of the chair and then to the ground to restrain him. They were careful as possible not to hurt him, but he was biting, clawing, etc.

If there was only 1 or 2 cops there, I can see how they would need to take him to the ground as quickly as possible. Just because he can't move his legs, doesn't mean his arms were weak. If he rolls his own chair, his arms are probably buffer than most peoples here. To restrain someone, it is very hard to get the cuffs on them, if they don't want to if they are not laying on the ground. He probably did less harm to him by taking him to the ground.

Please....p_rushing.....DON'T try and use common sense and logic in a thread that has to do with police officers.
Everyone knows that they have no families(because they eat their young immediately upon birth)....hate everyone and simply cannot wait to get to work and beat down on anyone on "the list"(you do know there is a list of undesirables that you get when you get out of the academy of those you have to hassle/beat and kill without any though or fear of reprisal.....as a matter of fact, if you don't do so within 30 days of leaving the academy to at least 4 types on the list...you are put on desk duty)
The guy was paraplegic for Christ's sake...where was he going to go? If necessary, they should have just let him be...for however long he refused to be cuffed and arrested...an hour...a day...a week...a month...heck a YEAR! Whatever he wanted!

God Bless all lawyers and lawbreakers.
It would be a terrible world without them.

I'm sorry but 9 people against a guy with use of half a body. I know parapelegics have strength but there's no way that that many people was necessary

"The first thing we do, let's kill all the lawyers". - Henry VI (Act IV, Scene II).

If it was not for lawyers we would enjoy very few of the freedoms that we have today in our civilized society. No one would be around to protect those from the abuse of those granted police powers by the locality in which they live. Without anyone to stop it society would turn into a police state with those with power never relinquishing it. That was the reason Henry VI wanted to rid the world of lawyers, not because of the way we commonly get portrayed in popular culture.

No police officer has ever overstepped his or her authority and crossed the line between enforcement of the law and breaking the law themselves. Never before have police officers devised a story after the fact in which to protect their own interests, job, or potential civil liability for their actions. Never before have police officers failed to abide by the protections granted by the United States Constitution or the Constitution of the state they work in. At all times police officers abide by every single rule to ensure that every measure was taken to protect constitutional rights and protections. No police officer would ever conduct an illegal search and seizure. No police officer would ever use force than any reasonable person could deem as excessive

This would of course never be true in a city like Cincinnati, it isn't like that police force has a history of using excessive force in which large settlements or judgments were paid out. And of course, those who have the job to provide legal representation for those dastardly, vile criminals do not have rules of professional conduct that they must follow. Even if they did, none of these rules would govern the statements they could make to the media about the case at hand before a jury heard it. Surely though even if these protections were in place, no lawyer would face any sort of liability for violating those rules, I mean it isn't like they could ever be suspended from the profession or lose their license to practice law.

Oooooooohhhhhhh, wait. Police do cross the line and sometimes use force that is excessive. Well certainly when they do that people should just lie down and take that abuse and accept that it was probably just an honest misunderstanding, and that no harm was meant by their actions. And well if any injuries were sustained as a result of those actions, they should again just accept it, pay for all medical costs themselves and not dare burden the locality or its police department with a reimbursement for costs, regardless of their ability to pay their medical bills. Meanwhile, those officers who did cross the line (inadvertently of course) should not face any sort of punishment, as because if we give them time to reflect upon their actions, they will realize they were wrong and correct their behavior in the future to ensure it never happens again, I mean there is absolutely no chance whatsoever that said behavior could esculate and become worse over the years. And most definitely the citizens of that locality should never, under any circumstances be made aware of those actions by the police, as it will only cause doubts and fears in the local police.

Yes, the best idea would be to follow Henry VI's advice and kill all the lawyers. That would certainly lead to a better society. Because we all know absolute power does not corrupt absolutely and that with great power does not come great responsibility.
