I must admit I learned something with this debate. I always thought first degree murder was the intent to kill someone and second degree was not the intent to kill, but the person ended up dying.
What do you guys think - Wrong or Justified?

I could be wrong but you have Voluntary Manslaughter which was intent to kill but without premeditation. But there are mitigating circumstances I think??
Then Involuntary manslaughter would be killing someone without the intent to kill, then its divided from there to 2 or 3 other things as well lol.
Criminally negligent homicide is also similar.
In reality, I don't see this guy going down for Murder 1. He will probably take a pea to one of these charges above.Comment

Nobody is arguing that the guy was in the wrong. We were arguing with Scott in reference to 1st vs 2nd degree murder.
This statement is utterly ridiculous. I get calls for service about hearing noises in the attic, hearing a knock on a window, etc. The city of Charlotte has had two recent shootings were kids robbed people and were killed. If I posted the shootings here, I could see several people saying some sort of crime should've been brought upon the shooter. Charlotte didn't prosecute either person.
Having some vigilante justice where those who have their life endagered start taking out threats...oh that will save money for taxpayers, victims, and improve the quality of life in communities.
Who knows how many additional people would have been robbed if these persons were still alive?
1) I don't attack anyone. You taking offense to it, or telling me to "please stop" is not welcome with me. I deal with the same type of people you do, except I deal with them every single day.
I realize that no one was arguing that he was wrong, but obviously this thread has taken on different directions in the past few pages.
Unless you're willing to post the exact details on the Charlotte shootings, you have no bearing here. NONE. This was about a guy who shot a dude in the dead. The other assailants got away and he pumped five more shots in the (I assume) incapacitated kid. He died as a result and now the courts get to sort out that mess.
Sorry, but I can't STAND the attitude you possess. If you disagree that's fine, but don't come at me with that BS.
My opinion is not anymore valid than anyone else but your first sentence is what strikes me as arrogant and self righteous. Am I allowed to speak in this discussion without you telling me to stop?
Because otherwise, I'll bow out if I don't have your permission. I know where you're coming from. I know your line of work. Please, drop the elitist attitude just because you're in law enforcement.

I'll be honest. 2nd degree murder looks appropriate.
That being said, I have no sympathy for the kid who was killed while in the midst of armed robbery.
If you pick up a gun with ill intent then you are rolling the dice. That kid rolled the dice, and lost. He paid with his life and that's completely on him. No matter what the actions of the pharmicist were. If that kid doesn't arm himself and go out with the intent to do bad, he's still alive today.
