Woke up to the news that one of my good friends was arrested over the weekend for DUI with a .24 BAC. It's their 2nd overall Offense, but first in the State of New Jersey. Other incident was years ago in Pennsylvania and was expunged. They were released and awaiting trial.

There is a big difference in penalties, fees from 1st to 2nd Offenses in NJ. Can the Legal system use the expunged DUI from PA against them to conclude a 2nd Offense. Or will this be considered the first In state Offense? They are going to be in a world of hurt if they can't drive to work, (quite a distance). Why did they do something this stupid....

.24? Wow, he was definitely drunk. Not sure what's going to happen to your friend, but when I got popped for one over a decade ago, I learned my lesson, for sure. I can't imagine the judge granting him too much leniency.

I would assume expunged means that it is gone from his record so no digging it up. Not to mention a different state. Laws could vary state to state as well.

Sadly, it doesn't matter the punishment, people will always test it and some will fail to varying degrees.

As far as driving to work, I forget what it's called, but I was basically given something that allowed me to drive during work hours. Assuming he isn't fired, he might be able to get that.

Restricted Drivers License I believe it's called. Allows you to drive in the daytime for work, school, necessities, and medical purposes.

Going to try and offer moral support the best I can, but really disappointed in this person.. Oh and they're going to be hit with an Insurance surcharge of $1,000 per year for the next 3 years.

Oh man, takes me back. Relief doesn't even begin to describe it.

Nowadays, we're older and somewhat established and it wouldn't be a life sentence. Back then though? Catastrophic.

I agree with what you're saying, but having kids is still a life sentence. My loser brother is 36 and is probably just as big of a pain on my parents now as he was in his teens and twenties. Of course, if he didn't have kids (well teenagers now) my parents wouldn't enable him as much, but since he does it makes things difficult for them.

As for me, I'm 35 and my wife is 33 and I'm still terrified of them. They seem like a lot of work and like too much of a "wild card". I don't think they're in the cards for us, honestly. I'd go ahead and get snipped if I knew for certain that my wife wouldn't have a change of heart in a few years.
