Yes. They can.

This whole "licensed" BS is just that. You don't need a damn license to make a good game that sells well. Winning Eleven soccer has proven that already.

Irrelevant. Please read page 4 and 5.

Edit: Winning Eleven soccer is a vastly different case. Where is WE made?

OK, now THAT article may convince me towards your side. Again, I don't agree EA is FULLY to blame, as it does take two to tango (ie, the NFL had to agree to it, the NCAA had to agre to it, etc), but I do get where, regardless of who initiated it, it can be taken to court as a monopoly.

Why is WE different? EA owns the FIFA license and the large majority of soccer leagues. WE/Konami owns a few now but none a few years ago. They were in the same boat as 2k or any other developer is in right now. Also it doesnt matter about where WE was made because Konami could sue EA in any jurisdiction that WE and FIFA are distributed (including the US). Konami decided to make a better game and give gamers a franchise mode and the option of editing players, teams, stadiums etc. If 2k did that we would be talking about All Pro Football 2k10 instead of seeing people cry over a business decision made by EA.

Well, from reading that, it seems that the reason this is being allowed to go on is because they claim EA raised their prices after eliminating the competition. They state that the release of Madden 06 at $49.95 was a 75% increase over the previous year's game - which is a complete LIE. Madden 05 was the same exact price when it was new. So was nearly every other new game released at that time. Then it goes on to state that EA is currently releasing the games at $59.95..which again is the same price as any other new game.

Some of you guys must not be keeping up with the NCAA boards. NCAA's rosters are whacked to hell and back this year, and there are tons of people who are saying they won't buy the game because of it. BackBreaker is going to be the real test for how well a game can sell without a license.

Face it...BackBreaker could end up killing Madden in terms of its graphics and physics technology...but still sell 1/10 (or fewer) games as Madden. Why? No license.

See, I'm still tending to lean your way. How is the FIFA license any different?

WE is made by a Japanese company in a sport that is much, much, much more popular in Japan / Europe / Asia than it is here in the United States. FIFA is made by an American company in America, where soccer is not popular at all. Of course it sells fine.

This doesn't even factor in that licensed players could be much different in a different sport in different countries... who knows if people in Britain or Turkey care about licenses? This case is about American sports in America, not soccer all over the world.
