40 man roster glitch

So in my first season of franchise I released a handful of players right before the draft and resigned them after the draft, so they would retire after the season and less players that shouldn't retire, won't (Fielder, Texeira, Fernandez etc). Well when I resign David Ross to the Cubs and try to add him to the 40 man roster, I get the "only major league free agents may be added to the 4o man roster between November 20th and the rule 5 draft in December" message. Well, it's the first week of June and I don't know how to get around this. I tried trading him, releasing and resigning to another team but I get that message no matter what. Has anyone seen anything like this or know how to get around it? I guess I could just create a new David Ross out of a random FA that is going to retire anyway but I don't really want to

What were the details of the contract? If you don't sign him for enough money or to a contract where his role is 'Depth' then The Show recognizes it as a minor league deal and he isn't automatically added to your 40 man roster directly after you're notified of his signing.
