Actually, it's not.

The pictures are obtained from the schools and are provided to EA and many other otlets for various promotional uses. The images are the property of the institutions, not the athletes. Athletes at most schools have to sign releases to this effect.

I'm not trying to defend Ryan Hart, despite my ties to Rutgers, but this case more legs than Kellers who was suing just because of ASU QB#13, where as this is a legit photograph of Hart and his complete likeness. As long as the athlete, EA, and the NCAA all signed the proper paperwork then this is null and void and we all can move along...
