In the US, everything is trademarked as soon as it is created, though not pursuing the trademark for so long, letting it become a "meme" might be arguable enough that the trademark was abandoned. Maybe. If they can't successfully argue that, the meme guys will probably win.

Kellogg's has no case against the Nyan cat, unless the original art referenced the Kellogg or Pop-Tart names. You can't trade mark a food, which is why you can buy generic Pop-Tarts.
