License has nothing to do with it.
The game can not be prevented from being played regardless of the hardware it is being played on. NFL can not stop anyone from BCing any game.

License has everything to do with it because tht console isn't just playing a disc.

Game is played off the disc, rather than the disc just acting as physical DRM for you to receive a new copy distributed to you with a wrapper on it to allow it to play on the Xbox One.

I'm sure there's some additional nuance there, but that's the long and short of it.

It is not being played off the disc on 360 either...if it was all Xbox games would be playable on 360 and not all are compatible

There were installs where applicable, but emulation on the 360 was accomplished by modifying an emulator to make games compatible with the hardware, which is why the emulator was updated over and over and over, rather than games updated and released the way they are on the modern hardware.

Games weren't modified, so much more flexibility with licensing on existing titles. Can't modify titles with expired licensing and redistribute them, the way current backward compatibility is employed.
