I don't think it's 'hate' so much, I think it's more like 'concern' people are voicing here.
And I agree, that NBA2K9 is a great looking and animating game. And Live is trailing far behind in visuals and animation IMO.
To your point ALOT of people are quick to say that Live is truely NextGen but, the game after all these years still animates horrible.
In any case, the 2k team knows the gameplay issues that are in this year's game and some of them have been in this franchise for a few years now.
Also, this will be 2k's 1st full dev. cycle without their lead gameplay designer for the previous 3 NBA2K releases. Beluba leaving, had to be a significant adjustment for them also.
They (2k) have earned the benefit of the doubt, with their history of producing great basketball games. And I'm willing to give them that.
However, If underlying issues like court spacing, footplanting, CPU iso and pick and roll game, CPU playcalling etc...are not addressed this year, it's pretty safe to say that they do not have the technology/engine in place to resolve these issues.
In anycase, NBA2K10 will pretty much answer all questions in regards to whether or not the 2k developers have maxed out the current engine.
