I don't agree with the wiretapping law Maryland has but I don't see the cop doing anything wrong. He had his gun out for less then 30 seconds and never pointed it at the rider, as soon as he was within arms reach of the motorcycle he holstered his weapon. It's a dangerous roll of the dice at every traffic stop, the cops don't know if the person or persons pulled over have warrants or have a gun and don't want to go to jail.

I'm happy to say I have no virtue, no scruples, and no desire to wait too long for anything. In my humble opinion instant gratification takes too long!

Hoping common sense is a strength with the judge that gets this case.
Should take all of 5minutes:
Judge: Are you guilty of recording the police officer giving you a citation?
Defendant: Yes
Judge: You broke the law. I'm giving you a suspended sentence and 3 years of probation. Next time, keep the camera phone in your pocket.
Defendant: Yes mam/sir.
Judge: Bailiff, next case...Last edited by GAMEC0CK2002; 08-03-2010, 10:22 AM.Comment

I love it. Lindsay Lohan gets caught driving a stolen vehicle, while drunk and in possession of cocaine and she gets 13 days in prison.
This guy posts a video of a cop giving him a ticket and he faces 16 years.
Yup, nothing wrong with the justice system.
If I've learned one thing it's that you want to commit crimes in LA. Especially if you're a celebrity. Go ahead and kill someone. But be wary of the consequences, you might have to pick up trash on the side of the road for 3 minutes and then hug the local sheriff and say 'sorry'.Comment

Re: Man faces 16 years in jail for videotaping gun-waving cop
Look again at 3:34 of the vid. Looks like another State Trooper vehicle behind him....and my guess is both vehicles had a dash light and sirens.
He knew he was a P.O before the guy said a word.
You always draw when stopping.
You aim when you must.
At no time did he point his weapon at anyone....and once the guy stopped moving the cycle...he holstered.

Again, the straw man arguments that pop up in these threads are ridiculous. I'm done.Comment

Uhhhh what? I've only been stopped by the cops once and it was when we were cruising late at night during a neighborhood looking very suspicious, even then the cop didn't have his gun out.Comment

Re: Man faces 16 years in jail for videotaping gun-waving cop
My main gripe surrounding this thread wasn't really regarding the base subject, moreso than the comments about convicting someone on an archaeic law and having them go to jail as to correct a "bad" law through appeals.
However, it's now REALLY funny seeing those in this thread, who's "combat" experience is likely playing paintball in the backyard or playing Modern Warfare 2, comment/critique proper protocol of patrol officers.
I don't see any wrong doing on law enforcements part. I also reference the most recent tragedy (that I know of) where two officers viewed the stop as "routine".

That being said however, it seems like either the videos usually don't capture the entire incidents or the reaction of people to standard operating procedure(who are obviously not understanding why they are in place) is usually quite....well...I really can't post it(T.O.S.) but you can figure it out.
....and I really don't want to derail the thread any longer, but although uniformed service does indeed come with an inherent risk, does that mean you shouldn't take precautions to not wind up on the back of a caisson?
That officer in no way menaced anyone...and clearly reholstered once the man put his hands in plain sight. Don't let your lack of knowledge on the subject cloud rational thought that an officer must protect himself at all times when making an arrest or even a traffic stop. To me...traffic stops are worse than a straight up arrest(granted....a cycle stop is a little less stress than a vehicle you can't really see into)....but if you start to get lax in ANY situation......you might not have to worry about that any longer.

I always unholstered or if I was with another officer covered my weapon during stops.
S.O.P. and a fool doesn't do it.

Sorry.
When they start giving out E.S.P. at the academy is when P.O.'s should stop taking this necessary precaution.

edit: forget it. He explained."It may well be that we spectators, who are not divinely gifted as athletes, are the only ones able to truly see, articulate and animate the experience of the gift we are denied. And that those who receive and act out the gift of athletic genius must, perforce, be blind and dumb about it -- and not because blindness and dumbness are the price of the gift, but because they are its essence." - David Foster Wallace

Re: Man faces 16 years in jail for videotaping gun-waving cop
You talk about thinking rationally, but you don't appear to follow your own advice. Your thought process is the same as an overbearing mother who overreacts by not letting her child play outside, because once and a while she reads stories about kids getting abducted by child molesters. Oblivious to the fact that 99.9% of the time, that doesn't happen.
However, no media outlet is going to publish a story along the lines of "Children playing outside, had an enjoyable experience (which happens 99.9% of the time);" nor are you going to hear stories about "Officer pulls over speeder, gave him ticket, and both went their separate ways (which happens 99.9% of the time)." Instead, all you hear are the negative stories, and then you base your entire rationale on that (however misguided it is).
