The part where it becomes planned to me is when he goes and gets another gun. What does he think he is going to do with that gun just shoot him 5 times, but not kill him?

The kid put himself in that position. How can you say what he was feeling? Have you ever been robbed at gun point? It might not have been his first time and he decided to send a message.
The kid put himself in that position. I believe not putting yourself in situations where you can get shot drastically reduces that happening.Comment

If he had the same gun and then shoots him maybe you can say he is in shock, but to go get another gun and then go shoot the kid 5 times with that gun, I have no other thing to say other than 1st degree.Comment

First degree is planned. But how long does it has to be planned for. He planned as soon as he went and got another gun. At least that is how I see it. And I am sure the DA will see it that way too.Comment

Oy, this schtick is getting old. Pretty much everytime you're incorrect about something, you come back with the old "agree to disagree". This was 2nd degree murder. Do you really think he premeditated drawing the guys into the store to rob him so that he could pull a gun on the kid and kill him? Do you really think he planned out being robbed that day just so he could kill somebody? As was said before, who's to say he was in his right mind? Being robbed at gunpoint sure would shake me the hell up.Comment

Normally First Degree means that it was premeditated well in advance. Since the subsequent shooting happened "in the heat of the moment" if you will, it should be 2nd Degree Murder. Either way its pretty dispicable IMO, but not premeditated First Degree Murder.Patriots
