My friend and I were trying to figure out the rule this past weekend. Lots of rules on how the expansion draft works but not where they pick. We looked at where past expansion teams drafted at but couldn't find the rule.

What is the rule on where they pick the first year in the league?

Seems to be determined as part of the expansion b/c going back to 1988 there isn't any consistency:

1988 - CHAH 8th, MIA 9th
1989 - MIN 10th, ORL 11th
1995 - VAN 6th, TOR 7th
2004 - CHAB 2nd

Ok so I wasnt quite right, this is from Larry Coon's CBA FAQ

"Expansion teams often have restrictions placed on their draft position in their first few seasons. For example, Charlotte was assigned the #4 pick in the 2004 NBA draft, and Vancouver & Toronto could not receive the #1 pick in the NBA draft for their first four seasons in the league."

Seems to be determined in a case by case basis, but they still don't get a top 3 pick.

And yes, Charlotte was actually assigned the #4 pick in 2004 but traded #4 and #33 to the Clippers and also agreed to take Peja Drobnjak in the expansion draft in exchange for the #2 pick.

I watched the 1995 draft lottery on YouTube but it just said Vancouver and Toronto had the 6th and 7th pick to be determined later between them. So you are probably right in that it will be different every time.
