Good for her for immediately reporting it to the police though.

Seems too many "normal" women either don't report it at all or too late.

He supposedly also passed a lie detector test that his lawyer had done.

Stubblefield's alleged crime occurred more than a year ago, McInerny said, but the investigation needed time.

"We feel that these are important cases for us to get it right," McInerny said. "We understand the ramifications both to the victim and to the suspect. This is a case that it took what it took for us to file charges this week. We take all these cases very seriously, especially sexual assault."

Prosecutors around the country have been extremely cautious -- some say too much so -- to ensure sex cases against athletes are airtight before they file charges ever since the Duke University lacrosse rape case imploded in 2007.

As far as I know polygraphs are inadmissible in court, so legally speaking this means exactly nothing.

That is correct. You can beat them, also who knows what questions were asked, etc. It just creates some doubt and added to the 1 year wait to bring charges, it sounds like some probably did/didn't think there was enough to bring charges.

You would think they had enough evidence with going to the cops, cell phone data/location, etc to file charges right away.

Hopefully you never have the misfortune of finding out for yourself how you would react to such trauma.

The other possibility for the delay is the length of time it took to test the rape kit. Nobody knows what the backlog of untested kits is in the state but it seems to be in the thousands (a partial count last year yielded 6,100), large enough that lawmakers are pushing legislation to corral them.

How ****ing sad is that? Both the fact that they can't test fast enough and the fact that there are so many. And people wonder why some women don't report. Go through all that and your test sits on a shelf for a year.

While it is sad and something needs to be done to make that testing more efficient, I doubt many victims even know that the test may sit for a year (much less use that to factor in their decision not to report).

That is terrible to have any DNA test take longer than 1 month at most.

Reading what his defense lawyer said and the DA said/did, this is a mess.

DA has him arrested instead of allowing him to turn himself in, sits on it until 2 months ago when first talking to Dana about it. Making the case about her mental capacity to provide consent instead of just rape. DA sounds like he is looking to move up the ladder to a better job.

Now the woman will have to be analyzed to determine if she is competent and argued in open court. She has a driver's license, has a criminal past where she took plea deals and I think I saw represented herself, so that goes against being disabled. Then you have her profiles that show she has some mental disability.

Unless there is some physical evidence of rape, it's going to be hard to prove either way. Since most of the time there isn't anyone else there, only the 2 people there know what happened.

The problem is they aren't assumptions. This is most likely why the case wasn't charged until now, unless there is some unknown evidence they won't be winning.

I'm not woman-bashing...but not every sex assault is legit.

Where I work the majority aren't legit. That doesn't take into account the number that aren't even reported though.
