    After watching the replay, Stewart BARELY touches Ward's car. Ward could have easily waited until after the race to share his choice words with Stewart, but no, he had to get out of his car right away and run down a moving vehicle.

      I don't think anyone is saying he intentionally ran him over. Their are some saying he meant to intimidate him and accidentally ran him over.

        It's hard for me to believe that Stewart could even see the guy.

        1) The race was at night.

        2) The racetrack was very poorly lit and they should be held accountable for that.

        3) Ward's racing gear was all black, very hard to see at night in a poorly lit place.

        4) I heard that Stewart told authorities that he couldn't see Ward. It was almost like he disappeared and reappeared when he hit him.

        5) The sprint car before Stewart avoided him at the last second, making me believe that he could not see him as well until he got right on him.

        Stewart has no fault in any of this. Blame the kid for getting out of his car, and then going into oncoming traffic. We sure have no problem blaming stupidity if that happened off the race course.

          Stewart won't be charged with anything for the time being.
          The sheriff investigating the on-track accident involving Tony Stewart that resulted in the death of a fellow driver says there is no evidence of "criminal intent" on the part of the three-time NASCAR champion.

                    The prosecution has the burden of proof, not the defense.

                    Therefore you must prove that he did it, he doesn't have to prove that he didn't do it.

                      Unfortunately in this day and age, we no longer have innocent until proven guilty. It's "call a lynch mob and blame the first person you can think of, regardless of evidence because someone has to pay right now".

                          It looked to me that Ward almost got hit when he jumped in front of the first blue car. So he was already in danger of being hit especially in a poorly lit area of the track. Unless another video can show a better angle, I just don't feel Tony had anywhere to go especially since Ward jumped down the track in front.

                            That's the bad part. Knowing that even if I wasn't guilty, I still had someone's blood on my hands. I don't expect Stewart to race great ever again. His career is probably done.

                              I don't really watch racing, so I won't even try to pretend to know whether Stewart could have avoided him or not.

                              But getting out of your car and charging after a race car that's still running in a race should earn you a Darwin award.

                              It's a shame because something like this should never happen.
