That woman who finally sued was hardly the first to be rather severely injured by McD's negligence, she was the first to do something about it.
Right, I remember this being national news and talkshows making fun of the person suing. But all in alll, she had a legit case and won.

As for the fastfood making people fat comment, what about the fact that places like McD's and BK adding chemicals to their food that make it physically addictive? I stopped eating fastfood 1.5 years ago now, and for the first couple of weeks I went through withdrawal symptoms. If in fact true that physically addicting chemicals were added to food that is incredibly unhealthy for you as it is, why should they not face liability for this?
It depends on whether or not the chemical was public knowledge (and I don't know the answer to this). If they (even in small print) acknowledge the presence of these chemicals, it's still the decision of joe customer to either purchase the food or not. If the company secretly placed these chemicals in their food knowing it was addictive without the educating the consumer, then we ALL have a case.

That's easy to say. 20-30 kids for each adult supervisor... that's hell.

Also must teachers have their break at that time. So if they had to watch kids they wouldn't get a break and that would be a major Law suit! lol.
I loved playing tag, but I was real fast lol. So I can't relate with to banned tag, but I can somewhat understand why lol. I hear what you say about teaching them the real world, but the truth is they are only a kid once, so let them feel like a winner. I am not saying sports are bad. I loved playing sports as a kid, but I was good. I would like to hear from the kids that have been picked last on teams and how that made them feel. My opinion is bias because I was good at games with speed. I guess I am for protecting kids feeling.

As for the cheerleading lawsuits. What about those coaches who play favorites and cut kids who deserve to be there just because they don't like them. Maybe you've never experienced that, but I actually have. My HS was horrible for choosing teams because of politics in the school, not talent on the field. When a kid who wants to participate is losing out because of this, why shouldn't they have some sort of action against the coach? Is this always the case? Of course not, but I think that if the person really feels that it is and wants to take a stand that there is no problem allowing a jury to decide if this kid just sucked, or if the coach is a douche bag playing favorites and denying someone of an opportunity.

In all three of these issues, you have shown that they can be treated as completely frivolous, but I hope I showed you that in fact there may be some issues beneath the surface that the media will never go into because they love making lawyers look bad. Bobby Knight was right when he said the journalists chosen profession is just one step above prostitution.

Now in this case in Attleboro, I haven't read the article, but I am going to guess that something happened to warrant this action by the school. Perhaps if the school supervised the children better during these games to insure that injuries don't occur it is a non-issue. I know when I was a kid, there was a another young adult whom had already stayed back 3x by 4th grade, who would terrorize kids at recess, yet the teachers and school who knew this was a problem did nothing about it. So what was a simple game between kids, would lead to a kid who should have been in 7th grade terrorizing 4th graders. The school could have taken more action before the ban for sure, but I highly doubt it was completely frivolous.
Again, I agree that in the eyes of the law, they're not frivolous.....but you still can't convince me that these are not ridiculous cases in the eyes of friggin common sense. Also, the amount of money involved is even more ridiculous. The McDonald's lady won $160,000 in compensatory damages, and almost won an extra 2.7 million in punitive damage (thankfully a judge reduced it to a measly $480,000). So she walked away with over a half-million dollars for spilling hot coffee on herself, and damn near walked away with almost 3 million dollars.
