I don't think this will be a landmark case. If he is found guilty the case law is very much against him and these aren't the facts to change the law upon. If he is found not guilty, there is no appeal so no new case law could develop. Ultimately this is a case about jury nullification. If he gets a good lawyer I really believe he can get off by means of a mistrial for a hung jury. You need to convince 12 people of his guilt, I don't know that you could successfully do this in California.
Any other state, I think he's guilty with little question. In Vermont there was a similar case where a farmer shot an intruder in the back in his house. I don't know if criminal charges were brought, but he was found liable in a civil action. The lesson learned from that Vermont case, shoot to kill not mame.Comment

My bad, I saw Pasadena and assumed California, my mind played a trick on me I guess with name association.
Okay now if I am breaking this down with a Texas jury, I still think a lot of the same issues apply. Texas loves to punish criminals but then again this man was taking the punishment onto himself. Property is viewed with more reverence in Texas than some other states.
I don't know, I guess wherever this is tried it is a matter of jury nullification, unlike California though, I don't know that you can get a Texas jury to disregard the law quite so easily. That being said you only need one out of twelve on your side.Comment

If you need food, then rob a grocery store or a bank. As MassNole stated, breaking into someones house can have a huge impact to the family. That family may never feel safe in their house again. Someone broke into our house once, stole cash out of my dad's wallet which was on a night stand next to his bed. My dad didn't sleep for over a month and became very eratic and paranoid to the point where he ended up selling the house and moved out of state. Until it's happened to you and you've been personally exposed to the ramifications of intrusion and violation, you can't know the impact it can have on others.Last edited by Trevytrev11; 11-20-2007, 04:18 PM.Comment

Seriously, I think this guy could have figured something else than shooting these two guys in the back.
I understand why some of you guys might think this is "justified", but if you guys had tape of a police officer shooting a guy that a homeowner pointed out as the thief who just robbed him, you'd be all over that crap.

A lot of you people clearly haven't been around the world and experienced it if you really think everything can be solved by "going and getting a job" or "applying for food stamps", or if you think there are a "million legal ways" to do something.
There are people in the world who have absolutely no other options, and there are people who are mentally unable to comprehend between right and wrong.
Why can't you wrap your head around that and realize sometimes things are terrible mistakes, and sometimes there is no other option.
People don't deserve to die because they broke into a house. They need to go to jail, or get the mental help (in certain cases) they need.
It's too bad so many people in this world think the way to solve crimes is to go and kill the person. That's no better than being a murderer.
I'm so absolutely disgusted by the people in this thread, that I'm just going to leave it now and hope I never run into people like you in the real world. I'm glad the people I know are mostly understanding and not so narrow minded.
