Yes from what I read it can pause and even be turned off. But it can not be disconnected tho. But honest if people are worried about been spy on. Turn the cam towards the wall at night or just pull the internet cord at night. Simple as that. I'm not worrying about MS and them spying on me. If they want to record me while I'm sleeping. Then so be it. I think the Kinect will be an awesome piece for the future of gaming. And this is coming from a guy who is 35 and has gone through every gaming system made since I have been a live. From pong to 360. Just had about ever gaming system made just about. So the Kinect isn't going to bother me. I know how unplug it at night.
With a PS4, I can upgrade the hard drive at anytime I want, I don't have peripherals attached to the system that I can't disconnect, and I won't have to pay to use Netflix, Amazon Instant Video, Youtube, etc. Hell, I can even play F2P games such as DC Universe or Planetside 2 without paying for PS+. There's just a lot more freedom on the PS4's end.
The Xbox One will not have user upgradeable hard drives, I can't disconnect the Kinect even if I have privacy concerns or just simply won't use it, and I'll have to pay for XBL if I want to use any of their entertainment apps. Microsoft has become very controlling of everything. I don't really trust them anymore.
Originally, the Xbox One wasn't going to come with a mic. I don't think there's any question they were trying to rip consumers off by not offering a mic with all new Xbox One's and then selling the new mics at $20+ and also selling the adapter to make 360 mics work with the Xbox One at $20+. At $500, there was no reason for the Xbox One not to already come with a mic. It might look like a relatively small issue for most but to me that was a big issue. It's something that I'm still pissed off about even though they halfheartedly reversed their stance on it.
For me, Microsoft has already proven their track record at this point. I don't have a whole lot of confidence in what they say or do anymore. The Xbox One looks like a fine console and I'm sure I'll get one a year or two down the road. Right now, I'm just not willing to look over some of the crap that Microsoft has tried to do or is currently doing. Not to say Sony is perfect. They certainly have their own problems but I feel a lot more confident in them than Microsoft which is sad considering how awful Sony did with the PS3.NCAA: Virginia Cavaliers

The only places I know that has it still to preorder for day one is Walmart website and Microsoft store on their website. I just recently preorder my system on MS store website becasue amazon for some odd reason sent me a email saying my order was cancel for some reason. So I am now getting my day one system off of MS website.Comment

All Microsoft has to do is give me the option to disconnect it and I'll stop bitching. If they allow me to buy an Xbox One without Kinect at $400, I'll give it some serious consideration. At this point, I don't think I can justify spending $500 on a system that doesn't allow the users much freedom at all.

Edit: To answer the question, every Xbox One will come with a headset now. Thankfully, Microsoft is caving in a lot of areas. However, none of my 360 headsets will work on the Xbox One without an additional adapter. Microsoft does have the higher quality headset in my opinion but the PS4 is backwards compatible. My PS3 headset will work fine on my PS4. Some actually prefer the earbuds. I certainly don't but at least everyone will have a headset now.
