    What puzzles me about everybody's reaction is that most seem to think it's perfectly normal for Microsoft to make a bundle on extended warranties because the system the launched with defects.

    The logic seems to be: "Well now that we know that there are many defective units because MS messed up, I should give them more of my money now in case I need them to repair my console." I wonder how many MORE extended warranties they've sold directly because of the poor quality control job they did before launch. There's something seriously twisted here.

    How much is that extended warranty anyway and what does it include? How much longer does it make the warranty?

        YES there is a defect and YES there is a 90 day warranty and YES there is an extended warranty you could get. PS2's had defected lasers on release. If I have one that I bouight 2 years ago and the laser goes bad can I get it fixed free?

          This is the kind of thing I was talking about. This applies in Canada, at least on certain products (appliances, TVs). Not sure about consoles.

            Not making up anything, this is a law. I learned that if it is a defect that is the companys fault then they are liable. Ofcourse it would have to be proved that it wasn't from carelessness and from all the faulty 360s, this guy would win easily if he woul file a case against them.

            I buy the warrantys also but why should I pay for a faulty system/tv that is the fault of that company. Is it enough that I paid for the product itself? I buy warrantys from my carelessness and if I break the system/TV so it could be replaced, it should be replaced if it is a defect from that company, and that is a law.

              According to this, the U.S. also has Implied Warranties and the Express Warranty (the 90-day warranty stated by Microsoft) does not void the implied warranty, which much like I've mentioned for Canada, is apparently based on the principle of "Fair value for money spent" and is governed by each state. THus if your state deems that for your $400, your console should be free of defects for at least a year, then no matter what MS says you'd win in court, provided you've used your console in a normal way. The 90-day warranty just means that within this period MS will replace or repair it without asking questions, unless it's flat out broken or there's beer spilled in it or something.

              So much for making up law...

                Go buy another 360 and switch the model # tags. Then take back the bad one. Its your only hope.

                    Yeah your probably right. Microsoft does have a solid customer service policy. Try dealing with sony.

                        just take it back to walmart and they will give ya another one, no need to worry about 90 days etc.

                        walmart > than the world lol

                        but they do take anything and everything back.

                        when i was in line getting my new 360 about a month or so ago, i lady had a 32 inch tv in a buggy, dust all over it and said she just bought it 2 weeks ago. this tv had dust bunnies upon dust bunnies. they took it back no questions asked lol

                              LOL...you quote an internet article as law. First, implied warranties depend on which state you reside and generally most states view a implied warranty of mechantability as only lasting for 6 mos. Some states only view it as lasting 90 days for electronic devices (found a few cases in MD). So in most states he can try to argue that he has an implied warranty but his machine was defect free for more than 6 mos so most likely he would lose.

                              Also it idiotic to even think that some individual would sue microsoft because of a defective 360 unless he was trying to start a class action suit. The cost of an attorney, court costs and discovery would be well over the 400 bucks he spent or the 150 he would pay to repair it. It would be stupid to even think about filing suit over something this small.

                              Pay the 150, call ms and hope they change their mind or return it to Walmart and scam them. Just dont act as if MS owes you something.

                                No according to the info I've posted, the law determines how long a lifespan each kind of product should have based on the "Fair value for money spent" principle. This is called the implied warranty. When companies put 90-day warranty on something, it means that within 90-days they'll replace it without any hassle. If your product stops functionning properly between the end of the manufacturer's warranty but before the implied warranty runs out then you can take the manufacturer to court and get them ordered to fix or replace the product. Of course that implied warranty doesn't apply if you've done something outside the product's normal use like spill liquid on it or dropping it for example. But that's also true of most extended warranties offered by manufacturers.

                                The tricky thing is that implied warranties vary between jurisdictions so the actual length of the warranty may be different depending on which state/province/country you live in. The main thing to know is that in general implied warranties are longer than any extended warranty offered by the manufacturer. Thus, all you get for your extended warranty money is the knowledge that you won't have to go through any hassle if your product stops working.

                                Few people know about implied warranties and manufacturers are obviously keeping mute about it because it would essentially eliminate the extended warranties market. Microsoft does mention it in the warranty information, mainly to state that wherever it is legal to do so, they void it. Still, if you tell them about your knowledge of implied warranties and threaten to take matters to court, they should replace or repair your unit, unless you live in a place that does not enforce implied warranties.

                                So before choosing whether or not to buy an exteded warrant, you should check if/how implied warranties apply to the product in your jurisdiction.
