LOL...you quote an internet article as law. First, implied warranties depend on which state you reside and generally most states view a implied warranty of mechantability as only lasting for 6 mos. Some states only view it as lasting 90 days for electronic devices (found a few cases in MD). So in most states he can try to argue that he has an implied warranty but his machine was defect free for more than 6 mos so most likely he would lose.

I didn't quote it as law, at least I don't think I did (maybve it was the "so much for making up law" comment that can be interpreted that way). I said that in Canada implied warranties are applied and simply posted a link to an article that mentionned it being applied in the U.S. as well. Maybe the article is not accurate as I mentioned I don't know how it works in the U.S. I did mention that it varied based on where you live and what product you are talking about.

Also it idiotic to even think that some individual would sue microsoft because of a defective 360 unless he was trying to start a class action suit. The cost of an attorney, court costs and discovery would be well over the 400 bucks he spent or the 150 he would pay to repair it. It would be stupid to even think about filing suit over something this small.

As for the idiocy of suing Microsoft over such a small amount, here in Quebec there is a system for all cases below $3000. It's called "Cour des Petites Créances" or "Small Claims". There is only a very small fee (Like $25) and you don't need an attorney. Since implied warranties are regularly applied here, then it's really just a matter of showing evidence of date of purchase and if it's within the implied warranty you win your claim and the case is closed. In such a case, you'd save about $100 on the repair fees.

Pay the 150, call ms and hope they change their mind or return it to Walmart and scam them. Just dont act as if MS owes you something.

MS does not owe me anything. I'm not the one who has a problem with their 360. Every post I've made in this thread was meant to help people who do. I believe I have been clear every step of the way that I can only vouch for how it works here in Canda, specifically Quebec, and that I did not know how this applies to consoles. I've stated it as fact for TVs and appliances due to knowledge of people who have won such claims or cases that have been reported on informational shows on the french CBC. I've also said at least twice that unless the 360 stops working during the first 3 months, it's probably an over-heating issue that is linked to improper ventilation. Still, the point of the thread was what could the original poster do with his problem. I have tried to help and others to the best of my knowledge while mentionning in every post that this knowledge is limited. I don't get why you seem so hostile towards my posts. Oh yeah, as far as scamming WalMart goes, that's not something I would do.

I've had a PS2 for 4 or 5 years now, never had any problems with it. This is what I expect when I shell out a few hundred dollars for something.

People buy gaming systems to last them for several years, not 6 or 7 months. Therefore, if it breaks after a short period of time, I'm gonna bust someone's @ss if they dont fix it or give me a new one.

Why dont you people just wish him good luck instead of jumping on his case about not getting the warranty. YOUR Xbox 360 didn't break, its easy for you to say all this stuff.

Implied warranties are there for a reason apparently.

I had 2 PS2's in the first 3 months of release. They had thier problems also. So your PS2 didn't break, it's easy for you to say all this stuff.

That implied warranty thing is in the warranty book that came with the 360,page 5.

I will say Microsoft handles things A LOT better than Sony. My launch PS1 lasted about 2 years then the laser burned out,launch PS2 broke after 9 months,I had to scam Wal-Mart but that one broke too,buy a new one that was messed up out of box then return that for the one I have now.

Nintendo? Well I've never had to deal with them because their **** don't break.

the barcode doesn't matter, it'll still come up at wal-mart. how do I know? well I bought a color and black ink cartridges off ebay for cheap. I rarely print anything in color so I never used the color cartridge. My printer ran out of black ink and I didn't want to spend $30 to buy a new one. I took the unused color ink cartridge to wal-mart yesterday and exchanged it for a black in cartridge. So of course, I never bought it from them anyways.

you were lucky that they actually sold that same exact product with the same upc code.. ive tried doing this when i was younger after getting some birthday presents. i didnt know where the hell my aunt bought this little electronic theasureus. walmart ran me out of the store because the product wasnt from them and i tried to pass it off as buying it there

you should seriously try the walmart thing, you could have a new 360 tonight or tomorrow.

but good luck on the MS repair. i went through 3 of them with MS, all getting rings of death and not loading any games. went to walmart got my 4th and havent had a problem since.

yeah i had them fix 3 of mine, they gave me 2 new ones and then repaired the 2nd one and all of them did not work. they ship their 360's in a thin brown package, wait til u see it. cant believe they would shipp a $427 console in it, its funny as heck. each time i received my package from them the box was beat to hell and back, no wonder it didnt work lol. good luck though, you could have had a 360 in a day or so, and you will be out for atleast a week or so. but at least MS is helping you out!!

for some future knowledge, if I were to walk into walmart and buy a system, How would I go about getting an extended warranty? Do I call MS with my system info a few days or weeks after buying the system or asap? Or Can I purchase it with my system at walmart and use my debit card all at once.

Id hate to give my credit card info over the phone to pay for the extended warranty over the phone

I agree 100%, if they have so much faith in the quality of their products it should have at least a year's warranty. I have not purchased a 360 and with all the systems problems I plan not to anytime soon. I feel your pain as I have went through the whole DRE crap on the PS2 until I got a free repair from Sony because I had the very first PS2 model and because of a lawsuit they were forced to repair all the earlier modelsfor free. Only problem I have now is that the disc won't spin half the time on load up and then I have to shake the system while upright slightly tilted and it usually loads up. I'm just trying to get through till November when the PS3 comes out. From now on I will always get an extended warranty as the track record with consoles has been very poor lately. IGN has said that 9 of their 360's has broken down, 4 buy one person. Microsofts 3-5% theory seems a little suspect to me.
