A Canadian woman parked her car on a Montreal-area highway in 2010 to help a group of ducklings; almost four years to the day later, Emma Czornobaj was on Friday found guilty of causing the de@ths of a motorcyclist and his passenger daughter who smashed into her car.
The jury was unanimous in convicting the 25-year-old on two counts of criminal negligence causing de@th, a charge that carries a maximum life sentence, and two counts of dangerous driving causing de@th, which comes with a maximum of 14 years in jail.
The Canadian Press reports Andre Roy, 50, who was traveling with his 16-year-old daughter, Jessie, on his Harley-Davidson, was driving an estimated 70 mph to 80 mph in a roughly 60 mph zone.
His wife was following behind them at a slower speed and avoided injury, and has said she doesn't blame Czornobaj for the de@ths; her husband died in her arms, and her daughter, who was pinned beneath the Honda Civic, died later in a hospital.
The AP notes Czornobaj wiped away tears when the verdict was delivered to a packed courtroom; she was released until her pre-sentence hearing on Aug. 8.
Czornobaj had stopped her car in the left lane of a provincial highway after spotting roughly seven ducklings on the median, reports CTV. The self-professed animal lover told the court that she did not see the ducklings' mother anywhere and was trying to herd them, with the intention of taking them home.

I saw this earlier and was confused. Is the "left lane of a provincial highway" like a shoulder or did she literally stop in the middle of a driving lane? Why didn't the guy on the Harley notice there was a car stopped ahead of him, or did she stop while he was behind her and he couldn't avoid her? Was there a hill or something obstructing his view? I have too many questionsComment

This is a messed up story. I feel bad for everyone involved. I'm not saying the driver trying to save the ducks did the right thing (it was both stupid and dangerous), but I sort of wish they'd dismiss the entire thing and let all parties walk away.
Obviously that's not how traffic laws work but it's just so sad.
I wonder if the motorcyclists would have died if they were following the posted speed limit? I'm sure the defense thought of this; just thinking out loud.
The whole story is just awful.Comment

Unless you couldn't see it until you were right on top of it, you should be able to stop before hitting a stopped car (seems it was speed, not visibility, that caused the motorcycle not to stop in time, the wife driving the car stopped).
But regardless she shouldn't face charges so severe, if at all. What she did was irresponsible, but not criminally negligent.Comment

Based on the other stories it sounds like the motorcycle was following too closely behind a car that was successfully able to swerve out of the way of the parked vehicle and didn't even have a chance to see the parked car.
There is definately time to stop even for a parked vehicle if you can see it in enough time.Comment
