The key difference is that it's not 2K/HB making the courses, it's a user-created course. Legally, I think there's no issue here at all. However, you're probably right that it wouldn't stop a lawsuit or cease & desist or other onerous/costly legal action, which is a headache no one wants. Getting sued or having legal action taken against you doesn't just happen to people that are on the wrong side of the law; in fact, I'd wager that the majority of corporate law is pressing cases where the plaintiff has no legal leg to stand on whatsoever but pursues a case anyway, because legal muscle works exactly the same way mafia muscle does. You want to argue with Luca Brasi about whether they have the legal right to force you to pay tribute?
All of this stuff was on PGA Tour Golf on the PC back in the 1990's (definitely the "Gold" edition). It's comical but these guys take advantage of the short memories / lower average age of typical gamers. Actually, the developers themselves may well not remember or know that this stuff was in many golf games back in the day. They also may not know what "golf" is, apparently....
To be honest, if I could find a version of "PGA Tour Gold" that still worked on modern technology, I would play that game more than any other game that's come out since that time. I'm not saying this out of hyperbole - it simply has everything in it that I would want in a basic golf game. It's a 25 year old game, by the way...
